1. PAYMENT TERMS Payment will typically be processed upon the completion of services using the credit card or ACH information on file. Payment Options: Credit Card ACH/Direct Debit If payment is declined or invalid, the Customer will have 14 days to rectify the issue. After 14 days, a penalty fee may be applied. Suspension of Service: FPM reserves the right to suspend services if payment is not received. Service will resume once the payment issue is resolved. Prepaying Customers: Customers who prepay for seasonal services are eligible for a 50% refund on the remaining portion of their services if the service must be canceled due to unforeseen circumstances. 2. DURATION OF CONTRACT This Agreement is valid for one (1) year from the date of signing or until terminated by either party. 3. LIABILITY AND INSURANCE FPM maintains liability insurance for damages or injuries caused by its services. The Customer is not liable for injuries to FPM personnel, except in cases of negligence or failure to adhere to outlined safety requirements. 4. TERMINATION CLAUSE Either party may terminate this Agreement with a 30-day written notice. Early termination does not absolve the Customer of obligations to pay for services already rendered. 5. DISPUTE RESOLUTION Any disputes arising under this Agreement will first be attempted to be resolved through mediation. If mediation fails, the parties agree to resolve the dispute through binding arbitration. 6. CUSTOMER RESPONSIBILITIES The Customer agrees to: Ensure the area(s) of property where technicians will be working is safe and free of hazards, including securing pets and clearing debris prior to service. Follow all instructions provided by FPM to facilitate scheduled services. Understand that inadequate preparation of these areas may result in rescheduling, cancellation, or additional charges for remedial services. 7. REPAIR AUTHORIZATION (Optional) The Customer authorizes FPM to perform minor repairs without prior written approval under the following conditions: Repairs necessary for the safe and functional operation of the pool/spa or its immediate area. I authorize FPM to use photos or videos of my pool/spa and surrounding area for marketing purposes* (Initial confirm you agree, NA to decline). *FPM agrees not to share any personal or identifiable information in these materials.
9. CONFIDENTIALITY AND DATA PROTECTION

FPM will ensure that all Customer data, including payment information, personal details, and service history, is stored securely and used solely for the purpose of providing services. FPM will not share or sell Customer information to third parties without explicit consent, except as required by law.
